Welcome to OkCard (website domain: okvcc.com, hereinafter referred to as “the Platform,” “we,” “us,” or “OkCard”) and the virtual credit card issuance and related services provided thereby (hereinafter referred to as the “Services”). These Terms of Service (hereinafter referred to as the “Terms”) constitute a legal agreement between you and the Platform. Please read these Terms in their entirety carefully. By using the Platform’s Services, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and unconditionally accept all provisions of these Terms. If you do not agree to any part of these Terms, please immediately cease using the Services.
1. Service Content
- The Platform provides online functions such as virtual credit card issuance, top-up, management, and inquiry, solely for lawful and compliant online payment scenarios.
- Virtual credit cards are prepaid virtual cards that do not offer overdraft or credit functions and are limited to consumption within the card balance.
- We reserve the right to adjust service content, rates, features, or restrictions at any time and will notify users through website announcements or in-site notifications.
2. User Eligibility and Account Responsibility
- You warrant that the registration information provided to the Platform is true, accurate, complete, and will be promptly updated.
- You are solely responsible for maintaining the security of your account and password and bear full responsibility for all activities conducted under your account.
- If you discover that your account has been compromised or poses a security risk, you must notify us immediately. We reserve the right to temporarily freeze or permanently close accounts suspected of violations or risks.
- Transferring, renting, selling, or otherwise allowing others to use your account is strictly prohibited.
3. Compliance Obligations
- You undertake to use virtual credit cards solely for lawful and compliant purposes and strictly prohibit their use for (including but not limited to):
- Money laundering, terrorist financing, fraud, gambling, pornography, drugs, illegal transactions, or other criminal activities;
- Violations of rules imposed by payment institutions (such as Visa, Mastercard, etc.) or merchants;
- Malicious cash-out, order brushing, bulk card number testing, or other actions that harm the Platform or third-party rights.
- If we reasonably suspect that your usage involves violations or high risk, we may, without prior notice, restrict top-ups, freeze cards, deduct balances, refuse transactions, or close accounts, and reserve the right to report to relevant authorities.
- You shall bear sole responsibility for any losses, liabilities, or third-party claims arising from your non-compliant use. The Platform shall not be liable in any way.
4. Top-ups and Fees
- Funds used for top-ups must originate from lawful sources. The Platform reserves the right to review, reject, or return abnormal or suspicious top-ups.
- All top-up, card issuance, and handling fees are based on the real-time rates displayed on the Platform and are non-refundable once charged.
- Balances in virtual cards do not accrue interest, are not deposits, and are not protected by deposit insurance.
5. Refund Policy
- Except where mandatorily required by applicable laws, topped-up balances, card issuance fees, and deducted handling fees are non-refundable.
- If the Services become unavailable due to reasons attributable to the Platform, we may, at our discretion, provide compensation but shall not be liable for any indirect losses.
6. Disclaimer of Warranties
- The Services are provided on an “as is” and “as available” basis without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or absence of viruses.
- The Platform shall not be liable for service interruptions, data loss, transaction failures, etc., caused by:
- Force majeure (including but not limited to natural disasters, cyberattacks, government actions);
- User device, network, or third-party service failures;
- Improper or non-compliant user operations;
- Restrictions imposed by payment institutions or banks.
- In no event shall the Platform be liable for any indirect, incidental, special, or punitive damages arising from the use or inability to use the Services.
7. Limitation of Liability
The Platform’s maximum aggregate liability to you or any third party shall not exceed the total fees you paid to the Platform in the preceding 12 months (or zero if no fees were paid).
8. Intellectual Property
All intellectual property rights related to the Platform’s website, software, and content belong to the Platform or its licensors. Without written permission, you may not copy, modify, reverse engineer, or use them for commercial purposes.
9. Dispute Resolution and Arbitration
- Any disputes arising from these Terms or the Services shall first be resolved through good-faith negotiation.
- If negotiation fails, you agree to submit the dispute to binding arbitration rather than court litigation (except for small claims court). Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) by a single neutral arbitrator.
- You hereby waive the right to participate in class actions or class arbitrations. The arbitration award shall be final and binding on both parties.
- The place of arbitration shall be the State of Delaware, United States.
10. Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States (without regard to conflict of laws principles) and in conformity with the Federal Arbitration Act.
11. Amendments to Terms
We reserve the right to modify these Terms at any time by posting the revised version prominently on the website. Amended Terms shall take effect upon posting. Your continued use of the Services constitutes acceptance of the amended Terms. For material changes affecting your rights, we will provide additional notice via email or in-site notification.
12. Termination
- You may cease using the Services and close your account at any time.
- We reserve the right to unilaterally terminate the provision of Services to you at any time, particularly in cases of violations, risks, or prolonged inactivity, without incurring any liability.
13. Miscellaneous
- Matters not covered by these Terms shall be governed by rules and announcements published on the Platform.
- If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
